Title Slide: Changing the Law | With Attorney Fitzgerald
Question Silde: What is one law you feel should be changed?
I believe, and this is a little bit bizarre because a lot of my work is actually criminal defense, it’s actually a family law statute, I think the child support guidelines need to be changed to be more fungible, if you will. And by that I mean, right now, it’s the standard 17% for one child and increases incrementally from there, and I think that, the way the child support statute is right now, it’s really unfair to the paying parent.
I think that the parent that doesn’t necessarily have placement or whatever else is really getting worked over by the legislature’s decision to enact such a rigid child support guideline. I think that one that’s actually a little bit more appropriate, that I’m more of a fan of, is Illinois.
Illinois has a child support guideline where it’s actually 20% for the first child, but it’s net. In Wisconsin, it’s 17% of gross, so before you even have your taxes taken out, you’re losing a full 17%. Where as for Illinois, it’s 3% higher at 20%, but it’s coming out of net instead of gross.
